Definition & Service Level

• GDH is the trademark of the courier service provided by GDespatch Hub Malaysia Sdn Bhd (1210473-X) as hereinafter “GDH”.
• A GDH shipment means the goods delivered from a sender to the receiver.
• All items to be shipped must have a valid address with receiver’s contact details and cannot be delivered to PO Boxes. If the receiver is unable to accept the service, the GDH team will reschedule the delivery two times free of charge in which after additional charges will apply.

• If the receiver cannot be reasonably identified or located, or receiver refuses delivery, then GDH shall use reasonable efforts to return the shipment to sender at their own cost. Failing that, the shipment will be disposed off or sold after 30 days from delivery date to recover the service & storage charges.

Acceptance of Terms of Use:

• The site is owned and operated by GDespatch Hub. Your access to and use of our site is subject to these Terms and all applicable laws. By accessing or using the site, you accept the Terms & Conditions without limitation or qualification.
• GDespatch Hub may, from time to time and in its sole discretion, modify, alter or otherwise change the Terms & Conditions with or without notice to you. All such changes will be effective immediately upon the updating of the page at which the Terms & Conditions are contained. You agree to check the Terms & Conditions and be bound by such terms as are in effect at the time which you access this site.

Data and information accuracy

• These web pages may contain inadvertent inaccuracies or typographical errors, which will be corrected periodically, and thus inaccuracies may remain or occur between updates.

Safety Declaration

I, the Sender (User), hereby agree that:
• I have verified and can confirm the contents of the goods which I am sending.
• I meet the legal requirements for ownership and possession of said goods.
• If I am sending any dangerous or prohibited/restricted goods or incendiary devices etc.,
• I am deeming that the Operator transporting the goods has all the required licences and certifications.
• All goods are classified, packaged, marked, and labelled/placarded, and are in all respects in proper condition for transport according to applicable International and National Governmental Regulations.
• I acknowledge that if the article I am sending is carried by air, that it will/may be subject to aviation security and clearing procedures, and I declare that in such a case it does not contain any dangerous or prohibited/restricted goods, explosive, or incendiary devices.
• A false declaration is a criminal offence.

I, the Courier (Operator), agree that:
• I have inspected all goods which I am transporting.
• I have the required licences and certifications to possess and transport the goods which I am carrying for the Sender (User).
• A false declaration is a criminal offence.

Prohibited, Dangerous, or Hazardous Items

• We will not accept any items that may be deemed dangerous or hazardous for handling, or prohibited by us. It is our co-operative responsibility to comply with current government and international shipping rules and regulations. Any shipment containing such items may be subjected to their order being cancelled without notice. The delivery of the following items or substances through GDH is forbidden:-

Indemnifications for Loss

• GDH will do all in our power for handing over the deliveries at normal delivery times, however this is not guaranteed and the delivery time does not form a separate part of the agreement. GDH will not be liable for any direct or indirect cost or any fines or penalties imposed.
• GDH guarantees that the shipment remains intact from the time it is received to the time it is handed over to the authorised receiver and will be liable to be blamed for the damage or loss of the shipment. GDH remains responsible for the shipment until the reception is confirmed on the shipping tracking by the signature of the authorized receiver or representative.
• The shipment is considered lost if it has not reached the authorised receiver or representative within 96 hours from the time that it should have reached the receiver according to the delivery periods that were valid at the time of making the service order.

Payment & Cancellation Policy

• GDH service fees are established according to the valid market price list inclusive of the fee for receiving the shipment and delivering it to the authorised receiver or representative. A right to amend the price list is reserved by the management of GDH or persons authorized thereby.
• All service fees are paid via our portal and other methods designated by GDH. No service fees are to be paid to our dispatchers directly (unless expressly stated) and if payment is done in such a manner without our consent, it is considered null and void and GDH will still charge for service fees to be duly collected.
• GDH have the right to suspend the processing of any transaction where we reasonably believe that the transaction may be fraudulent, illegal or involves any criminal activity or where we reasonably believe beyond doubt benefit.
• Any cancellation call and request after service initiated, partially and fully rendered will be fully charged. Any extra charges incurred via financial instruments will be at onus of the requestor.

Privacy Policy & Personal Data Protection

• At GDH, we are committed to protecting your privacy in accordance with the Personal Data Protection Act 2010 of Malaysia (“PDPA”). We embark all reasonable steps to protect your personal data and keep your personal data secured. This includes following our security procedures (like checking your identity when you call us). Our site may link to other websites and we are not responsible for their data policies, procedures or their content.
• We do not share personal information with third parties nor do we store any information about your visit to our website other than to analyse and optimize our content and reading experience through the use of cookies. You can turn off the use of cookies at any time by changing your specific browser settings.
• To fully access or use GDH tracking portal, kindly register for an account by providing your name, email address and your mobile number (as well as other required details). The details are personal to you and cannot be shared with third parties or transferred to third parties.

Force Majeure

• GDH is not responsible for any form of loss caused by force majeure circumstances. Force majeure means any circumstances irrespective of the will of the parties involved that cannot be foreseen or avoided in these conditions that restrict, partly or totally, the fulfilling of the obligations. A typical force majeure circumstances are: natural disaster, unforeseen weather conditions, war, export-import prohibitions, strike or any similar conditions but not limited to the stated circumstances.

Products and Services

• Unless otherwise agreed in writing, the products and services mentioned on this site are subject to GDH’s Terms & Conditions of carriage.

Limitation of Liability

• To the maximum extent permitted by law, in no event shall GDH, its affiliates or licensors or any third parties mentioned at the GDH site be liable for any incidental, indirect, exemplary, punitive and consequential damages, lost profits, or damages resulting from lost data or business interruption resulting from the use of or inability to use the GDH website and GDH systems, services, content or information whether based on warranty, contract, tort, delict, or any other legal theory, and whether or not GDH is advised of the possibility of such damages. Without limiting the foregoing, to the extent permitted by applicable law, you agree that in no event shall GDH’s total liability for any damages (direct or otherwise) or loss regardless of the form of action or claim, whether in contract, tort or otherwise, exceed RM 100.00. To the extent permitted by law, the remedies stated for you in these Terms & Conditions are exclusive and are limited to those expressly provided for in these Terms & Conditions.

Disclaimer of Warranties

• The services, the content and the information on this website are provided on an "as is" basis. GDH, to the fullest extent permitted by law, disclaims all warranties, whether express, implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, non-infringement of third parties rights and fitness for a particular purpose. GDH, its affiliates and licensors make no representations or warranties about the accuracy, completeness, security or timeliness of the services, content or information provided on or through the GDH web site or systems. No information obtained via the GDH systems or website shall create any warranty not expressly stated by GDH in these Terms & Conditions.
• You agree and acknowledge that the limitations and exclusions of liability and warranty provided in these Terms & Conditions are fair and reasonable.

Disclosure of Information

• All information provided to GDH by visitors to these web pages is considered to be confidential and will not be disclosed by GDH to any third party except as may be required for the provision of the services.
• Information obtained from users of these areas may also be used for GDH’s marketing purposes within the limits of national law. GDH provides a right of access and rectification of personal data under the applicable legislation.
